1. Acceptance of Terms

By accessing or using RecipeClip ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

RecipeClip is a recipe management application that uses artificial intelligence to extract, organize, and manage recipes from photos and URLs. We offer free and paid subscription tiers. Features and limits may vary between plans and are subject to change with reasonable notice.

3. Account Terms

• You must be at least 13 years of age to create an account and use the Service.
• You must provide accurate, complete, and current information when registering. You are responsible for keeping your account information up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately at support@recipeclip.app if you suspect any unauthorized access to or use of your account.
• You may not share your account or allow others to use your account credentials.

4. Acceptable Use

You agree not to use RecipeClip to:

• Violate any applicable local, national, or international laws or regulations.
• Upload, transmit, or distribute any content that is unlawful, harmful, or infringing.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Use automated means (scrapers, bots, crawlers) to access the Service without our prior written consent.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
• Harvest or collect personal data about other users without their consent.

5. User Content

You retain ownership of the recipes and content you save to RecipeClip. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of operating the Service. By making recipes public, you grant other users permission to view them. You are solely responsible for all content you upload and for ensuring you have the right to share it.

6. AI Processing

RecipeClip uses Google Gemini AI to extract recipe information from photos and web pages. AI-generated content may contain inaccuracies, omissions, or errors. You are solely responsible for verifying all extracted recipe information, including but not limited to cooking temperatures, cooking times, ingredient quantities, and allergen information before relying on it. We are not liable for any harm resulting from errors in AI-extracted content.

7. Payments & Subscriptions

• Paid subscriptions are billed on a recurring monthly or annual basis through Stripe. By subscribing, you authorize us to charge your payment method on the applicable billing cycle.
• You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will not be charged for subsequent periods.
• All fees are non-refundable except where required by law or as we determine in our sole discretion on a case-by-case basis.
• We reserve the right to change pricing with at least 30 days' advance notice. Continued use after a price change takes effect constitutes acceptance of the new price.

8. Intellectual Property

The RecipeClip brand, logo, design, software, and all related intellectual property are owned by AvaPhylix and are protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included software without our prior written consent. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVAPHYLIX AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless AvaPhylix and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as agreed by the parties.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or by displaying a notice on the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
